USER TERMS AND CONDITIONS AGREEMENT

1. ACCEPTANCE OF TERMS

1.1 By accessing, downloading, installing or using the GrannyDr Application (“App”) or Web Portal (“Platform”), You acknowledge that you have read, understood and fully agreed to be bound by these Terms and Conditions, the Privacy Policy, Medical Disclaimer, Telemedicine Guidelines and any other policies incorporated herein by reference.

1.2 If You do not agree with any terms in this Agreement, you must immediately discontinue the use of the Platform.

1.3 These Terms constitute a legally binding contract enforceable under the Information Technology Act, 2000, Telemedicine Practice Guidelines 2020, Digital Personal Data Protection Act 2023 and other applicable Indian laws.

2. NATURE OF SERVICES

2.1 GrannyDr provides a digital healthcare platform that facilitates:

• (a) Paediatric and family doctor teleconsultations (audio/video/text);
• (b) Clinic visit scheduling;
• (c) Developmental screening tools (Autism, ADHD, Growth, Speech Delay);
• (d) Health record management, E-prescription access and vaccination tracking; and
• (e) Medical knowledge repository and AI-enabled health assistance (informational, non-diagnostic).

2.2 The Platform does not provide emergency medical assistance, hospitalization or crisis intervention. In emergency cases, please contact local emergency services or visit a hospital immediately.

2.3 GrannyDr does not provide medical treatment and is not a substitute for in-person medical advice or physical examination.

3. USER ELIGIBILITY

3.1 The Platform is intended to be used by:

• (a) Parents, guardians or authorized adults (18+) for children or dependents; and
• (b) Caregivers who hold lawful responsibility for minors or special-care individuals.

3.2 Minors (below 18 years) may use the Platform only under the supervision of a parent or guardian, who shall remain legally responsible for compliance.

4. NO DOCTOR-PATIENT RELATIONSHIP WITH THE PLATFORM

4.1 GrannyDr is a facilitator and digital health technology provider. It is not a medical institution, clinic or hospital.

4.2 All medical consultations are independently provided by registered doctors using their licensed medical judgment. GrannyDr shall not be responsible for any clinical advice, diagnosis, prescription or treatment outcome, which solely remains the responsibility of the treating doctor.

4.3 Any communication on the Platform shall not be treated as a medical emergency consultation or diagnostic opinion.

5. USER RESPONSIBILITIES

You agree to:

• (a) Provide accurate medical history, reports and information to doctors;
• (b) Not conceal critical health conditions, allergies or disabilities;
• (c) Not misuse or fake symptoms for improper use of services;
• (d) Not contact doctors through personal channels outside the Platform; and
• (e) Maintain the confidentiality of your login credentials.

The User is solely responsible for accuracy and completeness of shared information.

6. APPOINTMENTS, CONSULTATION & CANCELLATION POLICY

6.1 Appointments are confirmed subject to doctor’s availability. Slot confirmation is not guaranteed until verified by the platform.

6.2 Missed consultations are non-refundable, except in case of technical/system failure.

6.3 Refunds due to doctor’s unavailability, technical errors or medical necessity will be processed as per GrannyDr Policies.

6.4 GrannyDr reserves the right to suspend or limit user access in case of repeated cancellations, abusive behaviour or fraudulent activity.

7. PAYMENT, FEES & BILLING

7.1 Pricing & fees for consultations, screening tools and digital services shall be displayed transparently on the Platform.

7.2 Payments once made are non-transferable and non-refundable, except under GrannyDr Refund Policy.

7.3 Digital receipts, tax invoices and payment confirmations will be available through the Platform.

8. LIMITATION FOR SCREENING TOOLS

8.1 Screening tools provided on the Platform are preliminary assessment tools. They are not diagnostic instruments and cannot confirm medical conditions.

8.2 These tools are designed as risk indicators only and must be followed up with clinical assessment by a qualified medical professional.

8.3 GrannyDr shall not be liable for: (a) False positives/negatives; (b) AI suggestion inaccuracies; and (c) Parental interpretation errors.

9. DATA PROTECTION & PRIVACY

9.1 All data usage shall be governed by the Privacy Policy, DPDP Act, 2023 and applicable health data guidelines.

9.2 Medical records, prescriptions, screening results and caregiver notes are stored securely on encrypted servers.

9.3 GrannyDr is authorized to sharing anonymized health data for research, statistics or compliance; retaining records for a statutory minimum of 3-7 years; and revoking access upon termination.

9.4 Users retain the right to request data correction or deletion (subject to statutory compliance laws).

10. PROHIBITED ACTS

You agree that you shall NOT: (a) Share login credentials; (b) Modify, copy or resell Platform features; (c) Contact doctors outside the Platform; (d) Use abusive language; and (e) Attempt to access hidden systems.

11. LIABILITY LIMITATION

GrannyDr shall not be liable for errors or negligence in medical advice, diagnostic failure, data loss due to third-party systems, or device incompatibility. The Platform is not liable for indirect, incidental, punitive or consequential damages.

12. TERMINATION / ACCOUNT DEACTIVATION

GrannyDr reserves the right to terminate or suspend accounts in case of inappropriate behaviour, data security violations, illegal activity, or repeated misuse of services.

13. GOVERNING LAW & DISPUTE RESOLUTION

This Agreement is governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of Courts of New Delhi, India.
